IU-Lorca asks for an official pronouncement on the paralysis of the files affected by the return of earthquake aid (05/07/2018)

The councilor of Izquierda Unida Verdes, Gloria Martín, has asked the Councilor for Recovery after the earthquakes, Saturnina Martínez, a public statement on the stoppage of actions to reimburse aid for the earthquakes of 2011 "while the autonomous community proceeds to the review of the files and makes effective the way of the justification of the fulfillment of the object and purpose of the aids through the inspection inspections of the works ".

Appreciation to the PSOE

Gloria Martín wanted to expressly thank the Secretary General of the PSOE in Lorca, Diego José Mateos, the efforts made so that tomorrow the Government Delegate in the Region of Murcia, Diego Conesa, to receive representatives of the Platform of Affected by the Return of The Aids of the Earthquakes (PADAT) whose actions are coordinated by the IU councilor at the request of its members.

Martín stressed that there will be three requests that the platform will make to Conesa.

In the first place the cancellation of the state part of the interest for delay.

Secondly, request the President of the Government or the Ministry of Public Works to urge the State Council to issue an opinion that clarifies how the calculation of the prescriptions should be carried out.

And, finally, that mediates with the Autonomous Community of the Region of Murcia for the implementation of a mechanism for justification of aid "fast" and "flexible", to demonstrate that the victims used the subsidies for the repair of their homes.

AGREEMENTS ADOPTED AFTER THE APPROVAL OF THE MOTION LAST JUNE 28

1º.- The Department of Management of recovery after the earthquakes will facilitate the municipal groups with representation in the Plenary of the Hon.

Lorca City Council a report on the status of the process of justification of the use of public aid in the repair of damaged homes.

In this report, it must include:

- Number of technical visits made (by dates).

- Number of technical reports drafted and sent to the Ministry of Development (by dates).

- Number of files resolved by this way of justification dictated by article 10. 1. b) of Decree 68/2011, of May 16.

- List of pending files of the municipal technical visit and the expected date for its completion.

2º.- The City Council of Lorca will strengthen the staff of the Department of Management of recovery after earthquakes to streamline the procedures for justification of aid for those affected.

3º.- The City Council of Lorca will urge the Regional Administration to paralyze the requirement of the reimbursement of subsidies as long as the files are not reviewed and the way of justifying compliance with the object and purpose of the aids through inspection inspections of works.

It will do so with communication to the interested parties and special diligence in the case of those who have already exhausted the administrative procedure, for which reason they are obliged to resort to the jurisdictional contentious administrative order to defend their rights.

4º.- The City Council of Lorca will request the Legal Council of the Region of Murcia to issue an optional opinion to clarify the calculation of the statute of the Regional Administration's right to the recognition and settlement of the reimbursement of the aid.

5º.- The City Council of Lorca will urge the Regional Administration once again, on its own initiative and in accordance with the provisions of art.

33 of Law 7/2005, of November 18, of Subsidies of the Autonomous Community of the Region of Murcia, in relation to art.

10.3 of Decree 68/2011, leaves without effect those requirements that affect beneficiaries of aid whose procedure of recognition and liquidation of the reimbursement has prescribed, proceeding to the file of the same and to its effective communication to the interested.

6º.- The City Council of Lorca will urge the Government of Spain to cancel the requirement of the state party to pay late interest corresponding to the aid for the 2011 earthquakes in Lorca.
