The spokesman of the Municipal Group of IU-V, Pedro Sosa, announced that he will defend at the next Plenary Session of the City Council, as an urgent motion, an initiative consisting of providing specialized human resources to the Department of Consumer Affairs to provide assistance to citizens of Lorca that have mortgages subscribed with the banks and that in their day assumed in their pockets the cost of the Tax of Documented Legal Acts (AJD)

The famous sentence of the Supreme Court, known last Thursday, October 18, and that brings the initial cause of a lawsuit filed by the City of Rivas-Vaciamadrid governed by IU, has finally given the reason to the citizens in front of the banking entities, forcing the latter to run with taxes that illegally transferred to customers.

The logic of the sentence is overwhelming, according to Sosa, the only interested in the mortgage consists in a public deed and register in the registry is the financial institution, as this ensures the recovery of the amount borrowed in case of default, Therefore, it is just that the bank is also the one who runs with an expense derived from an act that only benefits them.

The Spokesman of IU-V affirms that in this case his political group acts in the same way as other times before similar issues (as with the TS's own rulings on land clauses, or on capital gains) demanding the involvement of the City Council to provide free advice and solvent to its citizens in order to deal with the best possible way to the claims that must be filed, either administrative or civil.

Regardless of how the Supreme Court resolves the problem that its President has raised - in the interest of the banks - to be the Plenary of the Tribunal and not a Chamber of the same who decides on the scope of that ruling and its retroactivity, Sosa maintains that we must pay attention to the associations of consumers and users who, like ADICAE, encourage the filing of complaints as soon as possible with the bank, which also, depending on the chosen route, could include not only the request for refund of the tax of Documented Legal Acts (AJD) but also the registry and notary expenses, those of agency if any, and those of appraisal.

If the Supreme Court finally backs the banks, the consumer associations are convinced that the dispute will be brought before the European courts and that the failure of the courts will be, as on other occasions, favorable to consumers.

Sosa expects the local government to be receptive to your request and that the Department of Consumption will be provided with the appropriate qualified personnel to take on and provide the advice that the affected Lorca need to prepare and submit their claims.

The spokesman of IU-V calculates that there can be around 18,000 Lorca with living mortgages, if we take into account that in Spain there are 8 million (20% of the population) people who are in that same situation.
