IU demands support from the City Council for those affected by the return of the aid that will go to court (11/04/2019)

The councilor of Izquierda Unida-Verdes, Gloria Martín, regretted that the legal advisers of the Ministry of Development refuse to interpret the rules according to the most favorable criterion for those administered, which is a principle of law.

So they have made it known in a meeting with "legal" of the CARM which has attended this afternoon on behalf of the Platform of affected by the return of aid from the earthquakes of 2011. Martin defended the cause of the victims in 2015, they received a hearing procedure that CARM considers to have interrupted the four-year term that it had to demand the return of grants granted between 2011 and 2012, starting from scratch.

Those affected were given only ten days to present allegations to that hearing process that were then put in a drawer for more than two years.

For Martin it was a "trick" to encourage the interruption of the prescription knowing that the procedures for the reimbursement of aid would not begin until 2017, because 2015 and 2016 were electoral years and have requested the return of aid to affected at that time would have had a great electoral cost for the PP in Lorca.

Martín explained that, by analogy, rules can be applied that establish that the Administrations have a period of one month to initiate a procedure for the reimbursement of a subsidy since the competent body receives the pertinent report, which in this case was issued by the Mixed Commission and that was made known to the interested parties through the aforementioned hearing procedure.

For UI, that notification "is invalidated" by the extraordinary delay of the bureaucracy to initiate a procedure that should have been immediate.

Meanwhile, interest on arrears continued to run and generated a benefit for CARM and the State, co-financiers of the aid, which will now reimburse the amounts initially granted plus 40% in surcharges and interest for late payment.

The IU councilor said that the pressure and constant work of the citizen platform that coordinates, have managed to solve more than 3,000 cases for which an exit was found through Law 8/2018, approved ex profeso to simplify the procedures to justify the aid.

However, he assured that "we are not satisfied and we are going to fight for the rest, because we believe that reason and the law help them".

Therefore, he announced that tomorrow he plans to take the word of the Mayor of Lorca, Fulgencio Gil, who this afternoon has promised that the City Council, through an agreement with the Bar Association of Lorca, will be in charge of the legal representation of those affected who wish to defend their rights in the courts.

"If a judge gives us reason, we will demand that the sentence be applied to the rest of the cases, if it does not, the regional administration will prevaricate because it can not dictate an arbitrary decision in a matter knowing that it is unjust and contrary to the law." .

In that case, we would inform the Prosecutor's Office and investigate everything that needs to be investigated, he concluded.
