Plenary of the City Council requests the extension of the fiscal aid established to support the reconstruction of the city after the earthquakes (28/11/2016)

The objective is to maintain the IBI bonus, which allows Liquefs affected by earthquakes to pay half of this tax, which would be added to the incentives already provided for in tax regulations for taxes, capital gains and ICIO.

The Councilor for Economy and Finance in the City of Lorca, Fulgencio Gil, has reported that the Town Hall Plenary will request the inclusion of an amendment in the draft General Budget Law of the State for the year 2017, to maintain tax benefits Granted to Lorca in the Law 48/2015, of October 29, of General Budgets of the State for the year 2016.

The Edil de Economía has anticipated that this request materializes in the bonus of 50 percent of the quotas of the Real Property Tax corresponding to the year 2017, with the same requirements established for the exemption regulated in this Tax in article 12 of Royal Decree-law6 / 2011, of May 13, which adopts urgent measures to repair the damage caused by seismic movements on May 11, 2011 in Lorca, Murcia.

The bonus will be applied to the fee resulting from applying, if applicable, the other legally provided bonuses.

The reduction of income that this provision produces in the City of Lorca will be offset against the General State Budget, in accordance with the provisions of Article 9 of the consolidated text of the Local Finance Regulatory Law, approved by the Royal Legislative Decree 2/2004 of 5 March.

It is also requested the bonus in the Tax on the Increase of Value of Land of Urban Nature for the transmissions of the real estate that are carried out for the reconstruction of the zone affected by these earthquakes.

A broad normative base and several Royal Decrees

After the earthquakes of May 11, 2011, Lorca began the reconstruction or rebuilding of demolished houses and buildings, using the regulations approved by the three public administrations, state, regional and local.

3 Royal Decrees (6/2011 of 13 May, 17/2011 of 31 October and 11/2012 of 30 March) were approved, which defined, among other things, measures to contribute to the restoration of normality, as well as Procedures for coordination and collaboration between administrations, financing of expenses and coverage of damages.

It was a question of helping the citizens of Lorca and this City Council to re-raise the municipality after such a catastrophe.

The City Council promoted and defined the implementation of a tool to solve the blocking minorities that prevented many Lorca from rebuilding their homes.

The text was approved by the Regional Assembly of the Region of Murcia, conforming the Law 7/2012 of July 20.

In November 2011, the Local Administration approved the "Supplementary Rules to facilitate the relocation, reconstruction and repair of properties affected by seismic and catastrophic actions", a detailed guide for the repair and reconstruction of houses affected by earthquakes.

The Municipal Consistory maintains tax breaks to promote the process of rebuilding the municipality in the Taxes on Buildings, Facilities and Works (ICIO), Tax on the IVTNU (PLUSVALĂŤA) and the Regulatory Ordinances of the fee for issuing licenses for buildings, facilities and Works, as well as the fee for licensing of commercial and industrial activities.

The Government of Spain has exempted from the payment of the IBI quota to those affected by the earthquakes in 2011, 2012 and 2013, as well as the IAE quota, and has reduced the IBI quota and the quota by 50% Of the IIVTNU (goodwill) for the years 2014, 2015 and 2016,

Solidarity before the greatest urban catastrophe of contemporary Spain

Fulgencio Gil has stated that these measures of support to Lorca are derived from the fact that the magnitude of this catastrophe requires, from the constitutional principle of solidarity, immediate action by the public authorities to carry out, first, adoption Of various palliative and reparative measures that contribute to the gradual restoration of normality in the area and the determination of the financing of the expenses derived from such actions.

From the City Hall it is considered appropriate to request the extension for 2017 of the 50% bonus of the IBI granted to Lorca for the year 2016, as a reparatory measure that contributes to the restoration of normality in the area at the moment, since many The immovable property that was damaged is still gradually being rebuilt, and much remains to be done until full normality is achieved.

In addition, it is an exceptional measure in relation to immovable property that, as is being demonstrated this year, contributes directly to the socio-economic reactivation of the affected area.

The request to extend the bonus of 50% of the IBI to those affected by earthquakes is based on the following factors:

That the City is still in the process of reconstruction.

That 186 applications have been submitted for the extension of rental assistance to families who remain outside their homes and are pending resolution.

That the Law of the Region of Murcia 5/2011, of December 26, of extraordinary fiscal measures for the Municipality of Lorca as a result of the Earthquake of May 11, 2011, in its First Final Provision extends until December 31, 2016 The validity of the exemptions, reductions and tax rebates contained therein.

That also the Director Plan for the Recovery of Cultural Heritage of Lorca approved by the Ministry of Culture extends until 2016 the validity of the investments and funding lines provided in it for the recovery and rehabilitation of the extensive historical-artistic and cultural heritage of the city.

That at the present time it is still an intense action in the urban remodeling of several neighborhoods affected by the earthquake, as well as in essential road and communication infrastructure for the Municipality, with the interferences that this entails in the normal development of the Economic, commercial and social activity of the citizens of Lorca.

As regards the IIVTNU (surplus value), it is considered that this tax should not be an obstacle for the transfer of real estate to be carried out for the reconstruction of the area affected by such earthquakes, the quota for the Year 2017 in the same percentage of the 50% granted for the year 2016, given that the same reasons given to justify the bonus of 50% of the IBI quota concur.
