IU-V urges the city council to review capital gains tax after the recent ruling of the TC (22/02/2017)

The IU-V Municipal Group Spokesman, Pedro Sosa, has announced the presentation of an emergency motion for the Municipal Plenary next Monday in which he will address the revision of the municipal goodwill and will demand the return of the unjustly collected more to The citizens for that tax.

After the recent ruling of the Constitutional Court, made public last Friday, in which the high court annuls the municipal capital gain in the sale of properties with losses as it is against the principle of economic capacity contemplated in art. 31.1 of the Constitution Sosa warns that to continue demanding this tax from Lorca's taxpayers who sell at a loss is an injustice and a shame, and now it is also unconstitutional.

Sosa recalled that in the last two years, IU-V has raised up to three times the local government that modification of the Fiscal Ordinance.

Sosa recalls that on all three occasions the PP accepted our proposal, even though they know, as we know, that with that tax was being stolen many Lorca who, harassed by banks, had to sell real estate hastily ( Houses, ships, workshops, business premises), at a price considerably lower than the price at which they were acquired, and despite this, the City of Lorca was charging a tax, surplus value, based on a patrimonial increase that simple and It has not existed.

Sosa has expressed it clearly, stating that "if someone buys his house or his place of business for a thousand and must sell in haste for 500, he is not experiencing any increase in value in that transmission, and therefore should not be obliged To pay for it. "

We are also aware, says Councilman of IU-V, that the City of Lorca has been dismissing the administrative resources brought to them by Lorca's taxpayers, forcing citizens to bring the matter to court, when they were aware that Judicial procedure could cost them more than the tax.

So things, Sosa has advanced the agreements that will be included in his motion next Monday:

Modification of the tax ordinance that regulates this tax to provide it with constitutionality, and so that citizens, merchants or small businessmen who have been urged by banks to sell their houses or their premises are not obliged to pay the surplus value. Businesses at a loss, with an evident economic loss, so that afterwards the City Council will turn them an unjust and unconstitutional tax to finish them off economically.

Urgent preparation of a report of the technical tax services of the City of Lorca which states:

Detailed income (per tax subject bound to it and by amounts) for this tax that has entered the City of Lorca in the last four years.

Individualization of the income obtained by this tax when they enter into the factual assumption raised by the judgment of the TC.

In other words, what amounts - and to whom people affected - has entered the City Council of taxpayers who have paid the tax despite losing money in the transfer of assets that is in the taxable base of the tax.
