IU-Greens organizes a briefing for those affected by earthquake aids refunds (06/09/2017)

The Councilor for the United Left-Greens, Gloria Martín, has invited those affected by the refunds of CARM support for the 2011 earthquakes to an informational meeting that will be held on Thursday, September 14, at 8:30 p.m. hours at the Cultural Center of the City.

Martín explained that, given the "passivity" of the municipal government team of the PP, they have decided to "continue taking the initiative" to offer the affected "all the information we have" since it is a matter that is causing a important social alarm.

The mayor recalled that the agreement unanimously adopted by all political groups, including the PP, in the Plenum of the City of Lorca on 28 July, urged CARM "that the request for documents to justify the aid to those affected by the earthquakes of 2011 can be replaced, if there is no such documents, for an inspection of the dwellings to check if the works have been carried out. "

"We do not know the formal response of CARM to the agreement adopted by the Plenary," Martín lamented.

"We want to know what the Mayor is doing with the autonomous government, with the same political color, in order to comply with the mandate of the political representation body of Lorca," said Martín, who has said that "we are very afraid that they will be void because those affected by the earthquakes continue to receive notifications and nobody from the PP has breathed on this matter. "

Martín has expressed his concern after hearing from the victims that "from the Earthquake Office," inaccurate "information is being provided." We are sure that this is not an act of bad faith and we value the enormous effort that is being done in this department, in which they are sure to feel exhausted, as we are, due to the volume of claims.

But our obligation is to demand that neighbors be offered truthful information and optimal advice, "Martín said.

As an example, he recalled that the current regulations establish that the Administration has a period of four years to demand the return of the subsidies in case they are not duly justified.

A period starting six months after the completion of the works (three months if the works were carried out before the granting of the aid), which the affected can demonstrate by means admitted in law, such as an invoice.

That is, someone who completed the rehabilitation of their home on January 1, 2012 (date that appears on the bill), had six months until July 1 of that year - to send the documentation to CARM.

From that date onwards, it begins to compute the limitation period which, in this case, would end on July 1, 2016. During that time, the majority of affected persons have not received any notification from the regional government that interrupts the limitation period.

However the computation that is explained to the victims in the office of the earthquake is the following: since a citizen is granted the aid, has a term and a half to carry out the works, from which begins to be counted the limitation period.

This information is not true and contravenes the provisions of Article 10.3 of Decree 68/2011, of May 16, which regulates aid for the repair and reconstruction of houses affected by seismic movements, which occurred on May 11 2011, in the municipality of Lorca, and which reads: "the justification by the recipients of the fulfillment of the purpose for which the aid was granted, will be made within six months after the completion of the works and, in the case of works already completed, within three months of notification of the Resolution. "

This rule should be combined with art.

33 of Law 7/2005, of November 18, of the Subsidies Act of the Autonomous Community of the Region of Murcia, which states that "at four years, the right of the Administration to recognize or liquidate the reinstatement" of a subsidy and that will be computed "from the day following that in which the period expired (6 or 3 months depending on the case) to present the justification on the part of the beneficiary, that is, the invoices."

For all this, Gloria Martín called for an end to the situation of "uncertainty and defenselessness" that are suffering and the Mayor, Fulgencio Gil, "enforce the agreements adopted by the institutional representatives of citizens."
