IU-Greens denounces the granting of license of works and activity to a feedlot that had decreed demolition order (09/04/2018)

The councilor of United Left-Greens of Lorca has denounced the failure of the City on the order of demolition weighing on a feedlot, whose promoter was sanctioned by the Department of Urban Development of the City of Lorca to violate the General Plan in terms of distance minimum of 500 meters to the urbanized land sectorized de la Hoya.

In addition, to carry out the work, the violator also failed to provide authorization from the Ministry of Agriculture and Water, according to the documentation that has been provided to IU-Verdes.

For this reason, Urbanismo declared the works "not susceptible to legalization" and ordered its demolition on May 20, 2014, without it having been carried out almost four years later.

The Urban Planning Intervention Service itself found an "aggravating factor" in the offender's actions due to "resistance to orders issued by the authority, related to the defense of urban legality", a responsibility that also extends to the technical director of the works, since the construction of the ship was continued in spite of the orders, first of paralysis, and then of demolition.

In the diligence of notification to the offender, he was ordered to proceed with the demolition of a ship of 360 m2 in a period of 30 days, with warning that in case of non-compliance "the actions would be executed by the municipal brigades or personnel hired cost of the obligor ", in accordance with the law, which has not occurred.

As if that were not enough, the farmer also did not perform the actions required by legislation on animal welfare at the time, so the Head of Animal Health Service of the General Directorate of Livestock and Fisheries of the CARM proposed the reduction of the authorized capacity to a maximum of nine reproductive sows, as provided for in Royal Decree 1392/2012.

In an extemporaneous way, the offender asked the Ministry of Agriculture and Water for a favorable report on the extension of their exploitation in relation to an animal gestation ship of 360m2 (the ship declared illegal) with capacity for 90 breeding places.

The Ministry of Agriculture did not find "inconvenient" to such expansion and issued a favorable report without assessing compliance with the minimum distances established by the General Plan, nor the conditions imposed by applicable sector regulations related to the annoying nature or health risk or environmental, not even the previous breach of the legislation relating to animal welfare.

As if that were not enough, in July 2014, after an ocular inspection of the Ministry of Sustainable Development and Territorial Planning, it is found that there are 280 breeding mothers on the farm, which flagrantly violates what was stated by the applicant for authorization in the project, according to the complaints of those affected.

And finally, in March 2016, the deputy mayor of Urban Planning, Saturnina Martínez, granted activity and works license to the feedlot affected by a demolition order from her own council, dismissing the allegations presented by the Neighborhood Association of La Hoya and six families directly affected, covered by complaints from SEPRONA.

Therefore, those affected accuse the Lorca City Council of "prioritizing the economic interests of this farmer against the rights of citizens" and "not defend the current legality", so they have had to resort to the interposition of a contentious-administrative appeal that is awaiting judicial resolution.

In this regard, Martin has requested explanations from the Councilor for Planning on the granting of an activity license and works to a farm that, at the same time and with the knowledge of the City Council, "violated the General Plan and had decreed a demolition order by of the consistory itself. "

The General Plan has not changed in this regard and requires that the new extensions of pig farms are not less than 500 meters from the urbanized land sectorized, something that continues to violate this exploitation.
