The Full Council confirms its support, "unconditional" to the residents of the village of tips Calnegre (31/07/2013)

Were asked to perform the necessary steps that the town remains Calnegre tips included in the list of cores that are excluded from the maritime-terrestrial public domain, under the seventh additional provision.

The Municipal Council of Lorca has unanimously approved a joint motion of the three groups with municipal representation which emphasizes the unconditional support of the City to maintain the village Calnegre tips, consistent with claims that keep their neighbors.

This motion further calls on the Government of Spain to take the necessary steps so that the village remains Calnegre tips included in the list of cores that are excluded from the maritime-terrestrial public domain, under the seventh additional provision in extension which is set in the plan referred to in the new Law 2/2013 of 29 May.

This agreement also includes that in the case of not getting the tips Calnegre village remains included in the list of cores that are excluded from the maritime-terrestrial public domain, under the seventh additional provision, to the extent that is set in the mapping provided in the new law 2/2013 of May 29, the city of Lorca urge the Government of Spain to the realization of a new surveying and marking in populated area Calnegre tips located in the hamlet Lorca Ramonete.

Remember that the tips Calnegre village construction began over 200 years ago due to fishing activity that took place in this area.

Everybody knows the anomalous situation that it suffers, leading to uncertainty and anguish neighbors.

In March 2008, the High Court dismissed the administrative appeal filed by the city of Lorca and the Association of Neighbors against the Order of the Ministry of Environment of August 11, 2005 to pay their conformity to planes and mapping January 2004 updating the boundaries, leaving the town of tips Calnegre in maritime-terrestrial public domain.

Law 2/2013 of May 29 protection and sustainable use of the coast (amending Law 22/1988 of July 28), in its first article states: The shoreline area or space between the low water mark skewed or maximum equinoctial alive, and the limit to the extent of the waves in the largest known storms.

Article 13 bis of the Act states that: The owners of the land upon review of the boundary are incorporated into the public domain will become holders of a right of occupancy and use, for which the administration officially awarded the grant, express waiver unless the person concerned.

The concession will be granted for seventy-five years and following uses and existing uses, no obligations to provide canon.

The final provision states: Within six months of the entry into force of this law, the government will approve the revision of the general regulations for the development and implementation of the law 22/1988 of July 28 and will dictate the precise regulations development and implementation of this law.

This law excludes 12 Spanish coastal towns, which have been listed as exemptions to this law.

We think, instead of 12, can be 13, including the town of Calnegre tips in this list.
