The spokeswoman for this group, Concepción Bravo, says that they are willing to assume many of the measures presented by Urbanism and municipal groups in the opposition but that the distance of 15 meters between farms and their houses is "inasumible"
The Stop 'Cebaderos next to dwellings' platform has formally presented a document with their contributions to be studied by the special commission that deals with the harmonization of residential and land uses in the municipality of Lorca.
Regarding the technical prescriptions proposed by the Department of Urbanism, the platform assumes all corrective measures that contribute to alleviate the harmful effects caused on the environment by pig farms.
It also agrees to maintain the non-extendable term of 15 years fixed in the process of legalization of pig farms, for its dismantling at the end of this transitional period.
And it accepts the elaboration of an Ordinance of the sector that includes the conditions and requirements applicable to existing farms that generate discomfort due to bad smells, as long as it respects the constitutional rights to the protection of health (art.43CE) and to an adequate environment ( Article 45 EC), since both underlie the right of citizens to enjoy a quality of life that is consistent with the dignity of the person, a fundamental right recognized in Article 10 of the Constitution.
The Platform, however, manifests itself against increasing the distance, from 5 to 15 meters, between the limits of buildings and slurry ponds with plots of residential use, which it considers "manifestly insufficient", according to the spokesperson of this Collective, Concepción Bravo.
He said that this measure "does not solve the problem" and contravenes Article 8 of the European Convention on Human Rights ["Everyone has the right to respect for his private and family life, home and correspondence"] European Court of Human Rights, recognizes in its Judgment of 9 December 1994, which sets precedents in environmental matters.
In that sense, he reminded the City Council of its obligation to protect individuals when they are affected in their rights.
"We believe, as the ECtHR argues, that the town hall is a public actor guarantor of the interests of the administered and that it is obliged to maintain a fair balance between the business economic interest and the right of citizens to the effective enjoyment of their domicile and their Private and family life.
Regarding the proposals made by the municipal groups, Bravo explained that the platform agrees with all those raised by IU-Greens and that the City Council should proceed to the re-elaboration of the relationship of the rural centers existing in the municipality, In accordance with the provisions of Law 13/2015, of 30 March, on land use planning and urban planning in the Region of Murcia.
Failing that, they would also accept the proposal of the Municipal Socialist Group that "those concentrations of housing that, without qualifying as core or urban land, should be taken into account, have a significant degree of consolidation in terms of number of dwellings per hectare, Of urban services or degree of occupancy of the dwellings as habitual residence ".
The Platform and IU-Greens also agree to indicate the 1,000 meters as the optimal distance between dwellings and farms (except domestic ones).
Bravo explained that Article 148.3 of Lorca's PGOM establishes that same distance for the districts of districts and the urbanized sectorized land of La Paca, Purias, and the nucleus of Casas de Don Gonzalo.
"There should be no distinction between what is not allowed in the different rural areas of Lorca when what is at stake are rights that must be protected by the public administrations regardless of the place of domicile of the citizen," he said.
In addition, this distance is the one in force in other autonomous communities, which affects municipalities "much smaller than Lorca."
Finally, Concepción Bravo reiterated that the Platform "is not against the livestock sector" and that, only, it acts in defense of fundamental rights "that must take precedence over economic interests".
"We understand that it is a difficult issue to regulate, but not impossible. We understand that it is difficult to ask the farmers to move their farms out of the population centers, because it entails a significant economic effort," said Bravo.
