The councilor of IU-V in the City of Lorca, Adoración Peñas, estimates that of the nearly 10,000 Murcia affected by the scam land clauses that banks imposed on their clients on mortgages, between 600 and 700 may be Lorca .
Given these large figures, based on the estimation made public days passed by ADICAE (Association of users of banks, savings banks and insurance), the councilor of IU-V intends that the City of Lorca, through the Department of Consumption and Of the OMIC (Municipal Bureau of Consumer Information), establish in time a timely service of free advice to Lorca affected by these clauses in their mortgages, making known to the public the existence of it.
Adoración Peñas recalls that the recent ruling of the Court of Justice of the European Union (published on 21 December 2016) declares the total retroactivity of the nullity of the ground clauses establishing that the Spanish jurisprudence that limits in time the effects Of the declaration of nullity of land clauses contained in the mortgage loan contracts in Spain, is incompatible with the law of the Union.
With this ruling there are already Spanish courts, including some in the Region of Murcia, who have declared that absolute nullity of the clauses that they consider abusive and through the appropriate sentences are forcing the banks to return all the money collected from Plus from the same signature of the loan, with repayment of the corresponding legal interest accrued from the date of each collection up to the date of this judicial decision.
The mayor of IU-V criticizes the lukewarm response of the Government of Spain, always next to the banks, since all they have been asked to do is "ask" the banks through what they call "voluntary code of good Banking practices ", which proceed to return to their customers what was overcharged.
That in practice, says the mayor of IU-V, is no use since it requires each injured party to file the corresponding lawsuit in their courts of first instance to claim that return.
Peñas maintains that the warm response of the Spanish government makes this initiative of IU-V de Lorca very necessary and timely, and in this regard has stated that the estimation of this proposal by the local government of Lorca would be a very good way to start the New "municipal course" of 2017. It would basically be to reorder the legal services that the City of Lorca has, without any additional cost for municipal coffers, and to establish in a timely manner in the OMIC of Lorca a technical and legal advice service to the scammed By the banks.
Neither discard, if this is estimated by the City Council, parallel formulas that have already been tried in Lorca with other issues as a possible agreement of collaboration with the Bar Association of Lorca to make effective such advice.
