The councilor of this training, Gloria Martín, has provided a claim type "in defense of neighborhood interests" that must be submitted before January 20 to force its resolution in Municipal Plenary.
The councilor of IU-Greens of Lorca, Gloria Martín, has denounced the publication in the Official Gazette of the Region of Murcia of the initial approval of the Budget of the City of Lorca for the year 2017 "without considering the departure of more than 1 , 4 million euros for direct management by the local districts ".
Martín recalled that his training demanded in plenary compliance with article 4 of the Organic Regulation of the Districts of the Municipality of Lorca, which sets at 2% the minimum percentage of the municipal budget to be managed by such territorial entities.
Given that councilors are not qualified to submit allegations to the budget in the period of public information, the mayor of IU-Verdes explained that "we have no other way than the filing of a contentious-administrative appeal to compel the PP municipal government team To comply with the Regulations and provide districts and districts with the resources legally entitled to them so that they can be administered in a participatory manner. "
In that sense, reminded the mayor of Lorca, Francisco Jódar, the ruling of the Administrative Litigation Room of the Superior Court of Justice of the Region, which forced a few months ago to the City of Murcia to meet the direct percentage they execute The different districts of this municipality.
Martín reported that he had sent a letter to the neighborhood associations of the municipality informing them of this issue and encouraging them to submit claims against the Budget before January 20, date on which, if there are no allegations, it will be considered definitively approved without need of new Agreement.
To that end, IU-Verdes has provided them with a standard document of allegation that must be submitted to the Town Hall Registration Office or electronically via www.portalciudadano.lorca.es.
Once submitted, the Municipal Plenary will have a period of one month to resolve them.
"We are confident that the PP will not evade the allegations of the neighbors and respect the regulations to prevent us from having to go to justice, something that we will do if they leave us no other way out," Martín said.
The councilor of IU-Greens ensures that the decision of the municipal government team of the PP to breach the Organic Regulation violates the principle of non-derogability established in article 37 of Law 39/2015, of October 1, of the Common Administrative Procedure of The Public Administrations [Administrative resolutions that violate the established in a regulatory provision are null].
He also recalled that the law allows claims against the municipal budgets to "any inhabitant of the locality, the official schools and chambers, trade unions, associations and other entities legally constituted to ensure professional or economic interests and neighborhoods, when they act in Defense of their own "(article 170.1 of Legislative Royal Decree 2/2004 of March 5, approving the consolidated text of the Local Finance Regulatory Law).
