It seems that the central government has not adequately addressed the aspirations expressed by both legal professionals and other political and social groups in Lorca and its region, to accelerate, after budgetary appropriation, the launch in Lorca of the new Palace of Justice.
It is a bad news that affects Lorca and the impartición of justice in this city, but also to the set of justiciable and professionals of the justice of the whole region, since the concentration of all the courts and its annexed services of all The jurisdictions that are in the city of Lorca, being the head of county, would also positively result in other localities of the Guadalentín.
But independently of the aforementioned, and maintaining that just claim, Lorca and the whole of the Guadalentín region are orphans of a court that attends the litigations that affect workers against their companies and vice versa, as well as against other public bodies Such as State Public Employment Service, National Social Security Institute, TA and EP Mutual Funds, General Treasury of Social Security, etc., are the so-called Social Courts, corresponding to the Social Jurisdiction.
Considering that this Region includes the municipalities of Aguilas, Puerto Lumbreras, Lorca, Aledo and Totana, which supposes a population that surpasses the 175,000 inhabitants, a comparative grievance occurs against the Region of Murcia and Cartagena that yes that they have this one service.
This situation not only affects workers and companies, but also is detrimental to professionals working with these groups: Advisions and Labor Agencies, Social Graduates and Lawyers, who have to move in the case of this Region to the city Of Murcia, for the celebration of judgments in the labor field.
This situation also extends to the absence of a Mediation, Arbitration and Conciliation Service (SMAC) in the social field, prior to the judicial process.
Again, unlike Murcia and Cartagena, where it is provided, the workers of our region, law professionals and the companies themselves have to move to the capital to be able to hold their extrajudicial conciliations.
It is necessary to remember that this service of mediation was lent during a time in the city of Lorca, using for this reason dependencies assigned by the City council of this City.
This service was provided on a weekly basis, pointing out one day a week for its completion and concentrating on that day the conciliation papers that had been registered.
Therefore from LEFT UNITED-GREEN we consider it necessary in a first phase to resume the start-up of a Mediation, Arbitration and Conciliation Service (SMAC) in Lorca, from the social sphere, with the intention of serving the workers As well as companies and professionals, and, in a second phase, and prior to the demands and actions that are precise, a Social Court should be set up to deal with and resolve all lawsuits Social character that are generated in the localities included in the Comarca del Guadalentín.
For all the above, we REQUEST the Plenum of the City Council to approve the following AGREEMENTS:
That the City Council transfers to the Government of the Autonomous Community of the Region of Murcia the need and convenience of the start-up of a labor conciliation service in Lorca called SMAC, as well as the creation of a social court in the future Palacio Of the justice of this locality.
That this agreement be transferred to the parliamentary groups represented in the Regional Assembly.
That this agreement be transferred to the Ministry of Justice of the Government of Spain.
That it be transferred to the Professional Associations of Social Graduates and Lawyers, as well as to the most representative trade union and business organizations of the Region of Guadalentín
