Yesterday, Councilmember Antonio Meca presented a letter to Mr. Mayor reiterating again "our interest in knowing in detail the justification for the subsidy that this City Council granted to the Union of Merchants of Lorca" on September 18, 2015 with destination to the project of the so-called Mercado del Sol or San Clemente, from the Improvement Plan of Productivity and Competitiveness of the Trade, to "provide the necessary furniture and commercial equipment to the so-called San Clemente Market".
This subsidy must be justified after a maximum of three months after completing the activity covered by the agreement.
In previous writings "we have requested the breakdown and sufficient and reliable documentation of the justification for the use of this subsidy, invoices, payment documents, etc.
as the Law marks ".
That money, as Mecca states, "came out of the City Council box" to the Union of Merchants as a subsidy of a private project and "must be justified" as dictated by the clauses of the signed contract:
"5- Justification
After three months at the end of the activity subject of this agreement, the Local Union of Merchants of Lorca must justify the realization of them, according to its budget, must provide before the municipal intervention the following documents:
- A classified list of the expenses and investments of the activity, with identifier of the creditor and the document, its amount, date of issue and date of payment.
- Originals of the invoices or documents of equivalent probative value in the mercantile legal transaction or with administrative efficiency, in its case, the documentation proving the payment, whose total amount shall correspond to the budget of the activities for which the subsidy is granted.
- A detail of other income or subsidies that have financed the subsidized activity, with indication of amount and origin.
All of the above is included in Royal Decree 887/2006 of 321 July, which approves the regulations of Law 38/2003 of November 17, General Subsidies.
Once the unexpired term of 15 days has elapsed and if the justification for the grant awarded has not been presented, it will entail the requirement of reimbursement and other responsibilities established in the General Subsidies Law.
9- REINTEGRATION, RESPONSIBILITIES AND PENALTY REGIME.
The amount received in the following cases will be reimbursed:
- Breach of the purpose for which the grant was granted.
- Failure to comply with the obligation to justify the subsidy received ".
