Through the minutes of the Local Government, Municipal Socialist Group has learned of a letter from Government Office, addressed to the mayor of PP which urges the City Council, under existing law enforcement, to reopen the prison deposit within one month
Socialist Councillor Isabel Casalduero announced today that the State Bar urged the City Council of Lorca to the reopening of the city prison deposit the PP mayor, Francisco Jodar closed unilaterally on 1 March.
The mayor explained that the City is obliged to keep open, by law, this infrastructure, which meant the opening end of a makeshift dungeon in local police departments that lack the minimum conditions of hygiene and safety for both staff to the detainees.
This is a facility "third serving policemen who have other tasks," said Casalduero.
In this sense, the PSOE Councillor asked "who will be responsible if some day there is some serious altercation."
Casalduero also referred to other consequences of the closure and the fact that families of the detainees as professional bodies and security forces or members of the judiciary, who were not consulted about the closure, have to travel far Sangonera jail.
Councillor Jódar socialite said he lied when he said that the savings that would close the tank, would impact on the poorest families of Lorca.
However, the amount of the cost of this service, most goes to the salaries of the ten local policemen who attended.
Therefore wondered whether Jódar Casalduero thinks dismiss these agents, because otherwise "we do not understand where it comes from savings for municipal coffers."
"Slap on Jódar"
Through the minutes of the Local Government, Municipal Socialist Group has learned of a letter of delegation of the Government, aimed at Jódar (check out April 1) which calls for the City under compliance with applicable law, to reopen the prison deposit within a month and you can read:
"The head of the judicial municipalities where there is no one prison, will assume, on a competitive company, the servicing of deposit held in custody, corresponding to the custody of the detainees to the municipal police judicial police functions "(Art.60 of Law 7 / 1985 of 2 April, regulating the bases of local government.
In the same letter, referring to the First Additional Provision of Royal Decree 190/1996 of 9 February that approved the existing Prison Rules.
It provides that "the Prison authority given to the councils of the municipalities head of the judicial district where there is no prison, for food and accommodation expenses of the detainees and maintenance of facilities, an amount per prisoner per day, to be determined by order of the Ministry of Justice and Home Affairs or equivalent regional resolution. "
In that sense, Casalduero recalled that the Ministry of Interior pays "religiously" EUR 35.44 per prisoner per day to the city of Lorca.
However, the mayor recalled that "there established channels for resolving disputes between public authorities" so that "the council must make the requested payment of penal institutions which means that is owed, after exhaustive breakdown and justification expenditures. "
If it had not been served their petition, "the City should have filed an administrative appeal and ultimately judicial," according Casalduero, "instead of putting the world hat and give an ultimatum to the Ministry of Interior."
Jódar Ultimatum
On June 18 last, the PP government team sent an official to the Government Office which estimated the costs of the prison service to 709,503 euros deposit for 2009 and ensured that only received the 56,610 euros Corrections for that period.
The letter ended with the requirement to pay "soon" to the dispute, ie 652,893 euros, and, at least the previous three years, and threatened to remove the service, dated September 1, 2010 if payment is not effective, although it is not until March 1, when Jódar decides to close the prison warehouse.
Following this closing, the Delegation of the Government requests a report to the Secretariat of Penitentiary Institutions, asking the intercession of the State Bar, culminating in a damning report on the illegality of the closure of the Deposit by the City jail and mandatory proceeding to its reopening.
If the City persists in its failure, the consequences would that Prison execute that obligation at the expense of the consistory, under Article 60 of the Basic Law of Local Government.
In short, for the PSOE is an "absolute disgrace" that the law of the State has given a slap on the wrist to the city of Lorca by the abolition of an institution, as the repository of our city prison, with more than 250 years of history .
Isabel Casalduero regretted that Jódar feel the love of Lorca and management "as his country estate" even though they look ridiculous and take decisions that severely handicap our city.
Therefore require Jódar Francisco seeking an urgent meeting with correctional institutions to try to reach an agreement which, on the other hand, "there is total bias."
