The Full Council of Lorca has approved a joint motion of the three groups represented in the municipality in which the membership of the City Council agreed to the manifesto prepared by the Lorca Bar which expresses total and absolute rejection of the reform of the Law of Judicial Organisation, under the current wording contained in the study, design or draft of such Committee of experts, while in some cases might involve the disappearance or loss of competence of our courts, sending this position to public authorities and agencies with jurisdiction in the matter.
From the Consistory are ratified in defending the maintenance of all the courts in the city of Lorca with at least identical to the existing skills and also defending its future enlargement, as well as the inalienable claim to have a seat unified and dignified court, urging the Ministry of Justice to the immediate construction of the future courthouse.
It also requests the Ministry of Justice ruling, as soon as possible on the offer made by the city from various places, for possible future location of Lorca Courthouse.
The approved text of the motion passed by the Municipal Council notes that the recent publication of the content of the study, project or draft of the new Law on Judicial conducted by a committee of experts at the request of the Ministry of Justice in March 2012 are expected to disappear from the judicial parties as we know them and, what is worse, the disappearance of the judicial offices located outside the provincial capital, in addition to the loss of any judicial infrastructure investment does not go in line with the announced reform.
As to the jurisdiction of Lorca concerns, it would mean the disappearance of the Magistrates' Courts Eagles and Puerto Lumbreras and the Courts of First Instance and Instruction and Criminal Courts of our city, that would be absolutely devoid of organs for the delivery of Justice, which is a staple service for citizens.
Also mean an end of Judicial Headquarters have a unifying different courts in order to provide better service and more worthy justiciable.
Such reform would judicial map, facing the approach desirable public services and citizens a clear decrease in the critical transcendental right to effective judicial protection, guaranteed in Article 24 EC
Beyond this, in the concrete case of the city of Lorca, beset by economic crisis, by the earthquake of 2011 May 11 and the floods of September of 2012, the decision to carry out the reform in current terms, will certainly a turning point in the history of the city, which will determine the possibility of development according to their potential as the third city of the Region of Murcia or its definitive core depression and fall as economic, cultural and management in the broadest sense of the term, of the Bajo Guadalentin.
